TruePoint Systems urges Texas businesses to look beyond cybersecurity tools and assess whether their security programs are properly documented.
LONGVIEW, TX, UNITED STATES, August 18, 2026 /EINPresswire.com/ — Many Texas business leaders believe their organizations are covered because they have an IT provider, antivirus software, backups, multifactor authentication and other cybersecurity solutions in place. TruePoint Systems is urging businesses to consider a harder question: If a breach occurred tomorrow, could they produce evidence showing that a qualifying cybersecurity program had been implemented and maintained before the incident?
Cybersecurity tools are important, but tools alone may not constitute a complete cybersecurity program. Written policies, employee training records, incident-response plans, risk assessments, assigned responsibilities and documentation of ongoing safeguards may also be needed to demonstrate that cybersecurity is actively managed across the organization.

Texas Senate Bill 2610, effective September 1, 2025, establishes a legal safe harbor for small and mid-sized businesses. It protects companies with fewer than 250 employees from paying punitive (exemplary) damages in data breach lawsuits if they actively maintained a recognized, documented cybersecurity program when the breach happened. In certain actions arising from a breach of system security, the law may prohibit the recovery of exemplary damages if a qualifying business can demonstrate that it implemented and maintained an appropriate cybersecurity program at the time of the breach.
The protection is not automatic, does not eliminate every form of liability and depends on the business and its specific circumstances.
